DEA can't control the use of illegal drugs. It's near impossible. Ontop of that, the fact that you are under the influence isn't the crime really. It's having possession of the drug. They can't say shit if it's smoked and whatnot. But if you're on here and mention large quantities...well, that's when I'd say you were the stupid one in saying so.
