I assume you mean Salvia Divinorum "Divinity Sage". As far as I know, it is becuase when they originally banned Psilocybin Mushrooms and other hallucinogens in the U.S. Salvia Divinorum's chemical compounds were not akin to any of the others, and somehow fell through the cracks. Eventually, they will most likely add it to the list, so get your fill why it's still legal.
